Use of Affiliate link and Affiliate platform (affiliate portal).

Affiliate Program Policy & Terms

1. Program Enrollment & Requirements

  • Eligibility: To join, affiliates must operate an active website, social media profile, or email list in good standing.
  • Right to Reject: We reserve the right to approve or reject any application for any reason.

2. Commissions & Payouts

  • Earned Rates: Affiliates earn [Flat fee of $40 USD] on the sale of an urn generated via their unique affiliate link or affiliate login portal.
  • Payout Schedule: Payments are disbursed on a [e.g., monthly / net-30 after purchase] schedule once a minimum threshold of [e.g., $40 USD] is reached.
  • Payout Hold / Lockout Period (Post-Purchase): 30day long hold for disbursement of funds after the purchase to make sure the customer doesn’t return the item.
  • Reversals: Commissions will be reversed or held for orders that are identified as fraudulent.

3. Promotional Guidelines & FTC Compliance

  • Clear Disclosures: Per Federal Trade Commission (FTC) guidelines, affiliates must explicitly disclose their financial relationship with our brand on every page, post, or video containing an affiliate link. Disclosures must be conspicuous (e.g.“I may earn a commission if you purchase through this link”).
  • Brand Representation: Affiliates must accurately represent our products. You may not make false, exaggerated, or misleading claims regarding features, materials, or performance.

    The 3 Golden Rules of an FTC Disclosure

    • The FTC requires disclosures to be incredibly obvious. They use thestandard that a disclosure must be “clear and conspicuous,” which breaks down into three main rules:
    1. Placement (Where it is)

      • It must be placed before the affiliate link or any call-to-action.
      • A user should not have to click “Read More,” scroll down the page, or hunt through a privacy policy to see it.
      • On video platforms (like TikTok or YouTube), it needs to be superimposed on the video itself or spoken aloud, not just buried at the bottom of the description box.
    2. Prominence (How it looks)

      • The text must be easy to read, in a font size that matches the rest of the content, and in a color that stands out against the background (no light gray text on a white background).
    3. Clear Language (What it says)

      • It must be written in plain English.
      • Good examples: “As an affiliate, I earn from qualifying purchases,”, “If you buy through this link, I get a small commission,”, or simply using tags like #Ad or #Sponsored right next to the link.
      • Banned examples: The FTC explicitly says vague terms like “Affiliate,” “Partner,” “Collab,” or ambiguous acronyms like “sp”, “aff”, or “thanks to [Brand]” are not compliant because the average consumer doesn’t always know what they mean.

4. Prohibited Marketing Tactics
To maintain brand integrity, the following practices are strictly prohibited:

  • PPC & Trademark Bidding: Bidding on our brand name, trademarked terms, or variations/misspellings in paid search ads (e.g., Google Ads, Bing Ads) is not allowed unless explicitly authorized in writing.
  • Spam: Sending unsolicited commercial emails (violating the CAN-SPAM Act), posting spam comments on forums or social media, or using automated bots.
  • Domain & Account Impersonation: Registering domain names, social media handles, or ad accounts that mimic our brand name or trademark.
  • Self-Referrals: Using your own affiliate link to purchase products for personal use to gain a discount/commission.
  • Self-Purchases: Pet Declaration, Inc. forbid affiliates from buying products through their own links and reselling, as it turns the affiliate program into an unauthorized discount scheme.
  • FTC Disclosure Mandate: Affiliates must comply with all local and federal advertising guidelines, including the Federal Trade Commission (FTC) Endorsement Guides. You must clearly and conspicuously disclose that you receive financial compensation for referrals. This disclosure must appear on the same page as, and in close proximity to, any affiliate links or product endorsements, and must be visible before a consumer clicks the link. Failure to comply will result in immediate termination from the program and forfeiture of pending commissions.

5. Termination & Policy Updates

  • We reserve the right to terminate an affiliate account and forfeit pending commissions immediately upon violation of these policies.
  • We reserve the right to update or modify these terms at any time with notice sent to your registered email address.
